Thank you for getting back to me on this issue. What will happen now is that your complaint will be moved to an investigative team. Yes, you are correct in that the Complainant is not involved in the voluntary resolution agreement process. The Recipient (the Academy) would have to inform OCR that they are interested in that approach. Be assured the action steps listed in that agreement would fall short of nothing less in that if OCR investigated and found a violation of the law, we would be asking the Academy to remedy the violation(s) in the same fashion. You can expect to hear from the investigator assigned your complaint shortly. Again, thank you for your assistance in this matter.

Sorry for not replying sooner.
After reading the bullets for the ECR, I do not want to go with that process
- although I consider myself very cooperative, the bullet that says the OCR does not enforce the agreement stood out.
So then the next section there is a bullet that says the OCR monitors voluntary resolution agreements
souunds like it is better.
It also mentions that the complaintant is not a party to the agreement, I assume that is me
and considering we are not in the school, that sounds fine.
hopefully I made some sense
Let me know if I need to sign anything or send anything else

Spoke to Victoria
- she said on Oct 25th when she called me to make aware of her handling the case,
she called the school to request a voluntary .... where they will respond yes they will work with the OCR (with out me) to develop a plan that the OCR will hold them accountable
or No they do not want to do it and then the OCR will investigate
the ECR - was an option where I and the school develop a plan with OCR facilitation, but OCR can not hold them accountable unless the developed plan is breached (and I denied that route because I will not know if it is breached)
Victoria said the office gives 180 days to complete the entire process - investigation included
as of today she is waiting for a response and data
she said she will contact me when she gets a response
