She has been tested by Ai DuPont Hospital and has been diagnosed with having "A life threatening food allergy" to Tree nuts and Peanuts and is prescribed a Epi Pen.

If exposed to (mostly ingested vs smelling) the allergen, then she will have anaphylaxis - see the information from Ai DuPont website(excerpt below):http://kidshealth.org/teen/food_fitness/nutrition/food_allergies.html

... is known as anaphylaxis. This is a sudden, potentially life-threatening allergic reaction. In addition to the symptoms mentioned above, anaphylaxis can cause swelling of the airway, serious breathing difficulty, a drop in blood pressure, loss of consciousness, and, in some cases, even death.

From the 504 document, here is one section that is fitting,

Specifically to her severe allergies - it limits the major life activity of "Breathing"

On page 4:

In understanding Section 504, it is important to remember some key definitions.

An individual with disabilities is one who: [Sec. 104.3 (j) (1)]

1. has a physical or mental impairment which substantially limits one or more major life activities; 2. had a record of such an impairment; or 3. is regarded as having such an impairment.

Major life activities are: [Sec. 104.3 (j) (2) (ii)] functions such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working.

Request for a 504 PlanHello

I do acknowledge the great work done to mitigate the allergy risks - So I am grateful, I do have to point out that it did take some persistence /insistence on my part.

However, I do believe she qualifies and would like to know my next step because of this disagreement.

Furthermore, the work done so far, I believe much of that effort would be covered in such a 504 plan, making the overall process easier.

RE: Emergency Plan for Baili

Hello Mr. Jennings,

Thank you for working with the nurse to complete a plan for your daughter. We would appreciate if medical feedback or input goes directly to the nurse. Individual plans must be completed as each child is an individual and so are their circumstances. The state gives guidelines and requires that the medical staff is the point of contact and follow through of such plans and procedures. Staff (teachers) can be trained but it is not a requirement. The nurse trains and informs staff of individual situations. If our nursing team feels there is a need for various plans based on the feedback from our parents, they will research the information accordingly, check state guidelines, and will move forward when they speak with us.

Thank you for your care and concerns. Your feedback is valuable and greatly appreciated.

Thank you,

Hello

Great to hear that there are safeguards for Baili. Thankyou

I would like to discuss the schoolwide plan that sets safeguards for all students with allergies. This will help not just currently enrolled students, but future students as well.

I wanted to talk to Mr. Moore and Dn first about the schoolwide plan to see if they support the plan before going through the effort of creating one.

But the receptionist said that Mr. Moore and/or suggest we talk about the plan first.

When you get a moment, please review the example plan and let me know when we can discuss.

Just trying to be proactive.

Thanks

Good morning,

Thank you for the Emergency Plan for Baili concerning her “Peanut, Pecan, Cashew and Tree Nut Mix” allergy. A copy has been given to Ms. McConnell as well. Also, Ms. McConnell has been trained to use an EpiPen should the need arise and I am not available (ex. Field trips). The Specialist Team has been instructed not to give Baili anything to eat. The cafeteria staff has been instructed not to give Baili anything to eat; should she drop her lunch, you will be called to bring her more food.

Should you have any questions, you can give me a call at: 302-324-8901 ext. 249.

Please advise if you have an emergency plan for Life threating allergic reactions. (not simple hives or itchy skin... but anaphylactic shock which can be fatal)

-One scenario is at breakfast there is a student who reacts to a muffin and they have an injection pen for allergies and the nurse is not at school as yet - what is the protocol.

Here is links to a recent cases to show the seriousness of this topic.
