She has been tested by Ai DuPont Hospital and has been diagnosed with having "A life threatening food allergy" to Tree nuts and Peanuts and is prescribed a Epi Pen.

If exposed to (mostly ingested vs smelling) the allergen, then she will have anaphylaxis - see the information from Ai DuPont website(excerpt below):http://kidshealth.org/teen/food_fitness/nutrition/food_allergies.html

... is known as anaphylaxis. This is a sudden, potentially life-threatening allergic reaction. In addition to the symptoms mentioned above, anaphylaxis can cause swelling of the airway, serious breathing difficulty, a drop in blood pressure, loss of consciousness, and, in some cases, even death.

From the 504 document, here is one section that is fitting,

Specifically to her severe allergies - it limits the major life activity of "Breathing"

On page 4:

In understanding Section 504, it is important to remember some key definitions.

An individual with disabilities is one who: [Sec. 104.3 (j) (1)]

1. has a physical or mental impairment which substantially limits one or more major life activities; 2. had a record of such an impairment; or 3. is regarded as having such an impairment.

Major life activities are: [Sec. 104.3 (j) (2) (ii)] functions such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working.

I do acknowledge the great work done to mitigate the allergy risks - So I am grateful, I do have to point out that it did take some persistence /insistence on my part.

However, I do believe she qualifies and would like to know my next step because of this disagreement.

Furthermore, the work done so far, I believe much of that effort would be covered in such a 504 plan, making the overall process easier.

RE: Emergency Plan for Baili

Hello Mr. Jennings,

Thank you for working with the nurse to complete a plan for your daughter. We would appreciate if medical feedback or input goes directly to the nurse. Individual plans must be completed as each child is an individual and so are their circumstances. The state gives guidelines and requires that the medical staff is the point of contact and follow through of such plans and procedures. Staff (teachers) can be trained but it is not a requirement. The nurse trains and informs staff of individual situations. If our nursing team feels there is a need for various plans based on the feedback from our parents, they will research the information accordingly, check state guidelines, and will move forward when they speak with us.

Thank you for your care and concerns. Your feedback is valuable and greatly appreciated.

Re: Family Foundations Academy - 504 plan request

I spoke with Mr. Jennings via phone this morning and had a very productive

conversation. Mr. Jennings voiced his concern regarding his daughter's

food allergy and wish to pursue a 504 plan to accommodate her. However,

Mr. Jennings voiced that he would prefer a school-wide implementation of a

health plan that would benefit all existing and future FFA students with

the same type of allergy. Based on this stated preference, it sounds like

both the school and Mr. Jennings are on the same page.

It's important to note that Mr. Jennings expressed concern with how timely

a school-wide plan will be implemented and wishes to continue his pursuit

of a 504 plan for his daughter if a school-wide plan cannot be implemented

very soon. He also voiced his willingness to assist with the timely

implementation of a school-wide plan if it will help.

I will communicate my recommendation for moving forward on this matter

with the school and offer to assist as needed in its implementation.
